This offer should not be considered as free travel. The credit card used to purchase your package along with a matching driver’s license need to be presented to redeem any gifts offered. Once gifts and tickets are issued, they are non-refundable. Westgate Resorts reserves the right to substitute lodging and/or gifts and/or tickets with comparable items of equal or greater value. Subject to qualifications, this offer is available to citizens of the United States, and in countries where registered. Travel must be completed through 4/21/2024.

HOTEL POLICIES: You must be a minimum of twenty-one (21) years-old to check-in. A valid photo ID, such as a driver’s license or passport is required at check-in. Your major credit card will be pre-authorized for a security deposit for any incidentals (varies per hotel). If you do not have a major credit card, some properties will accept a cash deposit. Special requests such as a rollaway bed or cribs are subject to availability and additional fees. Accommodations are based upon availability and provided by Westgate Resorts and affiliated hotels. Holiday travel requires a minimum of a three-night stay. You may cancel within (14) fourteen days from the date of purchase. Any cancellation of arrival after (14) fourteen days will result in a forfeiture of all monies paid. No refunds will be made for early check-outs. Reservation cancellation requests must be called in by the package owner 48 hours before check-in day. This offer will be considered Fulfilled without a refund if the Guest(s) fails to check in to their reservation.

TOUR POLICIES: Subject to qualifications. Offer is designed for married and cohabitating couples with a verifiable annual household income of $60,000 USD for U.S. Citizens/Residents, and $75,000 USD for Canadian and U.K. Citizens/Residents. Income excludes all monies derived from unemployment benefits, alimony, child support, or disability. Income from Social Security, permanent disability, and/or retirement may be excluded depending on the Westgate resort location. Minimum requirements may be higher and other qualifications may vary, based on destination and season of travel. Qualified participants are individuals between the ages of 28-68 who must attend a ninety (90)-minute discovery tour and sales presentation of Westgate Resorts, LTD (“Westgate”) in order to receive the offer.

Tour will take place at the Westgate Smoky Mountain Resort & Water Park. If married, cohabitating, or engaged, both individuals must attend the presentation together and present a valid major credit card; no pre-paid or reloadable cards accepted. Guest(s) must have a valid credit card in their name with an available line of credit to hold resort security deposit and taxes upon check-in. If married or cohabiting, both parties must provide proof of matching addresses by either a valid photo identification or another form of government issued identification. All qualified participants must speak English, or Spanish fluently.

Current Westgate owners may qualify for certain promotions if the above criteria have been met, and they are in good standing. Persons who have toured any Westgate Resort location within the last twelve (12) months, have participated in a Westgate discounted promotional offer requiring a tour more than twice in a lifetime, are traveling as part of a group (three or more couples or singles traveling together on separate packages) or are attending/participating in a sporting event, convention, or family reunion will be assessed a surcharge of the rental rate plus the retail rate of any discount attraction tickets that were included in the vacation package. The following conditions will be assessed a surcharge of the difference between the discounted package price and the full retail price of $1,017.00 USD or refused to tour without refund: 1) failure to qualify and attend the sales presentation or 2) consumption and/or being under the influence of alcohol and/or controlled substances during the Preview Tour. Tour date, time and/or location may be changed at the Resort’s sole and absolute discretion. A nightly resort fee plus tax will apply to packages that are determined to be non-qualified at Westgate’s sole and absolute discretion.

Discount Resort Store has the right to cancel or reschedule an event 30 days prior to the reservation check-in date with a full refund. This promotional offer does not apply to any previously booked events.

TERMS AND CONDITIONS: Discount Resort Store Music and Shine offer ends 4/21/2024. Owners and guests of owners that attend the event will tour, should they meet all tour qualifications. All are eligible to purchase tickets. The credit card used to purchase your ticket order along with a matching driver’s license will be required to be presented to redeem your ticket voucher. Except for those tickets purchased through and/or as part of a Westgate Experience package offer, all tickets are non-refundable once a ticket voucher has been issued for the ticket(s) at the Westgate Welcome Center. Discount Resort Store packages may be cancelled within (14) fourteen days from the date of purchase. Any cancellation of arrival after (14) fourteen days will result in a forfeiture of all monies paid. No refunds will be made for No Shows and/or early check-outs. Westgate reserves the right to substitute lodging and/or gifts and/or tickets and/or vouchers with comparable items of equal or greater value. Ticket prices are subject to change. Participants must travel with a valid ID and must adhere to the Terms and Conditions herein.

Offer is subject to availability and inventory. No pets are allowed at event (does not apply to service animals). Weapons are not permitted on property, regardless of concealed weapons permit. Westgate reserves the right to cancel any duplicate and/or conflicting reservation without notice to end user. Purchaser is responsible for all taxes, fees, and/or other government and/or airport-imposed charges. End user is responsible for all outstanding charges and fees incurred before, during, or after their stay, including but not limited to gratuities, meals, and/or transportation costs.

This offer is void where prohibited by law. All federal, state, and local laws and regulations apply. This offer cannot be exchanged for cash and/or monetary consideration, or used in conjunction with any other offer, promotion, or certificate. By accepting this offer, the end user agrees that Westgate Resorts will not be held liable for any actual or potential losses, including without limitations, compensation or consequential damages arising out of this offer or in connection with or by misrepresentation by a third party. Rights Granted by you: By participating in this offer and by attending any event sponsored or hosted by Westgate Marketing, LLC (“Westgate”), you consent to the recording and photography by Westgate, its licensees, successors and assigns, of your photograph, image, voice, actions, likeness, characterization, name, appearance, and performance, as used, edited, altered, fictionalized or modified by Westgate, in its sole discretion, in any and all media now known or hereafter devised, throughout the world, in perpetuity, including, without limitation, in and in connection with Westgate, or related Sites or services, in and in connection with any events, merchandise, services, products, marketing, film productions, art, commercials, and in and in connection with publicity, advertising, and promotion without any additional compensation, permission, approval or notification.

Disputes/Mandatory ARBITRATION: THIS OFFER IS GOVERNED BY THE LAWS OF USA AND FLORIDA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. Venue for any action arising hereunder shall exclusively lie in Orange County, Florida. In the event of any controversy, claim or dispute between the Entrant and Westgate arising out of or relating to the offer or the breach, termination, enforcement, interpretation, conscionability, or validity thereof, including any determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration. Arbitration proceedings shall be administered by the American Arbitration Association (“AAA”) and may take place via the Internet and/or telephonically in accordance with the rules of the chosen arbitration service provider. The arbitrator shall be neutral and independent and shall comply with the AAA code of ethics. The award rendered by the Arbitrator shall be final, binding on all parties, but subject to review in accordance with applicable statutes, rules and regulations governing arbitration awards. Judgment on the award made by the arbitrator may be entered in any court having jurisdiction over the parties. If either party fails to comply with the arbitrator’s award, the injured party may petition the circuit court for enforcement. The parties agree that either party may bring claims against the other only in his/her or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Further, the parties agree that the arbitrator may not consolidate proceedings of more than one person’s claims and may not otherwise preside over any form of representative or class proceeding. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or fails to comply with the arbitrator’s award, the other party is entitled to costs of suit, including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award. Binding Arbitration means that both parties give up the right to a trial by a jury. It also means that both parties give up the right to appeal from the arbitrator’s ruling except for a narrow range of issues that can or may be appealed. It also means that discovery may be severely limited by the arbitrator. This section and the arbitration requirement shall survive any termination.

You acknowledge and agree that, in any court case you may file, you WAIVE THE RIGHT TO A TRIAL BY JURY AND THAT YOU CANNOT FILE A CLAIM IN A REPRESENTATIVE CAPACITY OR AS A PRIVATE ATTORNEY GENERAL, OR FILE A CLAIM AS A CLASS, COLLECTIVE OR MASS ACTION OR PARTICIPATE IN A CLASS ACTION.

PET POLICY: Some of Westgate’s destinations are pet friendly. To find out if a specific resort allows pets, please ask your reservationist, or call 1-800-925-9999. Westgate’s guests who take advantage of the pet policy will be subject to an additional non-refundable and/or refundable deposit in an amount at the discretion of each resort. Registered service animals are not subject to Westgate’s pet policy and are not subject to any security deposit. Guests are responsible for the behavior of their pet and for all personal injuries and/or property damage related to their pet. Westgate, its employees, and its respective affiliates are indemnified and held harmless from all liability and/or damage suffered as a result of guest’s pets.
